Bengaluru: The High Court agreed with the decision of the victim to marry the life-imprisoned rapist in order to lead a dignified life in front of her neighbours and find peace and tranquility in her life and gave a rare order suspending the sentence.
Residents of the same village and students of the same college, the accused and the victim were in love with each other. However, in the case of abducting and raping the minor lover, the trial court sentenced the lover to life imprisonment. However, the victim, who submitted a certificate to the High Court, said that if she wants to lead a dignified life in front of her neighbours in the village, the only way is to marry the lover who committed the rape. She said, “both of us have agreed to get married now and thus I request that the life sentence should be suspended and he should be granted bail.”
After considering this certificate, the High Court opined that if the marriage is not allowed, it will adversely affect the dignity of the victim and thus, suspended the life sentence imposed by the trial court and granted bail to the accused.
Besides, the accused, the others too should not hurt the victim for any reason. She should be well taken care of. A division bench headed by Justice B. Veerappa has stipulated that the state government or the victim can apply to the court seeking cancellation of the accused’s bail if sheis not well taken care of. The bench has issued a rare order clarifying that this order will not set a precedent for future cases.
